Terms of Service

These terms govern your use of SwarmRacks services. Last updated: April 2026.

1. Acceptance of Terms

By creating an account or using any SwarmRacks service, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

SwarmRacks provides managed hosting (VPS, dedicated servers, web hosting), custom software and website development, and related managed services. Service details, scope, and pricing are defined at the time of purchase or in a written proposal.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials, all activity that occurs under your account, and ensuring that your use of our services complies with these terms and our Acceptable Use Policy.

4. Billing and Payment

Hosting services are billed monthly or annually in advance. Development services are billed per the written proposal. Failure to pay may result in service suspension. See our Refund & Cancellation Policy for details on cancellations and refunds.

5. Acceptable Use

You agree to use our services only for lawful purposes and in accordance with our Acceptable Use Policy. We reserve the right to suspend or terminate accounts that violate these terms without refund.

6. Service Availability

We aim to maintain high availability for all services but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. See our SLA page for response time commitments on managed plans.

7. Data and Backups

While we run automated backup jobs on managed plans, you are ultimately responsible for maintaining your own backups of critical data. SwarmRacks is not liable for data loss caused by hardware failure, customer error, or events beyond our control.

8. Intellectual Property

For development projects, ownership of deliverables transfers to you upon final payment. SwarmRacks retains the right to use general techniques, frameworks, and non-proprietary code components in future work.

9. Limitation of Liability

SwarmRacks liability is limited to the amount paid for the affected service in the 30 days prior to the claim. We are not liable for indirect, consequential, or incidental damages including lost revenue, lost data, or business interruption.

10. Termination

Either party may terminate service with appropriate notice. We may terminate immediately for violations of our Acceptable Use Policy. Upon termination, your data may be deleted after a 14-day retention window.

11. Governing Law

These terms are governed by the laws of the State of North Carolina, USA. Any disputes shall be resolved in the courts of North Carolina.

12. Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance. Material changes will be communicated by email to account holders.
